* ?Basement has nothing on the floor (extended power outages mean no sump pump, so the possibility of a flooding basement)
* ?Enough cooked food for a day

For winter storms I don't worry about the basement having nothing on the floor, but I usually make sure the fireplace is ready to go with some logs and all the blankets/bedding are clean and easily accessible. ?I have many fond memories of being stuck in our home, our family sitting in front of the fireplace sipping hot chocolate made over the fireplace, and us reading and playing board games by firelight and candlelight while we wait for the power to come back on and the snowplows to come through. ?Sometimes getting "stranded" at home can be a real treat: ?all your regular obligations are temporarily lifted, and you can just enjoy each other's company without any modern distractions.

Learning the Language of Rivers I: A History of Confusion

(I was an idiot and told a coworker I?d make his costume. I haven?t got a sewing machine, and hand-stitching takes forever. But it will be epic. Unfortunately, sewing (among other things) means that I haven?t finished research for our next Cataclysm post. A repeat of rivers shall have to do. I don?t grok rivers. Some folks seem to understand them on an almost instinctual level, whether they grew up intimate with them or developed that relationship later in life. That?s not me. My experience with rivers runs thusly: they?re gashes in the landscape with rocks in, where you have to watch for flash floods; the ones that ran throughout the year tended to do so at the bottom of very deep, very vertical canyons.

The Colorado Rivers runs through it. No, seriously, if you click to embiggen, you'll see a microscopic bit of water in that hole in the center. Also, there is a watercourse leading up to it. To me, a body of water that doesn?t usually dry up and that you boat around on is a lake. When we crossed the Mississippi River visiting family when I was a small child, I got overwhelmed by the experience ? it should not take more than thirty seconds to cross a river, except at Hoover Dam, where the traffic brought you to a crawl on top of the dam. But that was okay, because the river was still a narrow ribbon at the bottom of a very deep canyon, and thus exactly what a river should be. Not this wide, muddy monstrosity that you could barely see the opposite bank of. That?s not a river, silly people. It?s a very long lake, or perhaps a freshwater inland sea.

I knew rivers had floodplains, because people in Arizona like to build houses in them. They?re nice, flat ground near that dry gash in the desert that sometimes gets water in it, and is frequently very green and lovely what with all the trees that have drilled down to suck up the water that?s sunk deep into the ground. People never worried, because there was never any water there ? except every few or a dozen or fifty years, when we?d get a really wet spring or monsoon, and their houses would sing ?I?m Sailing Away? like Cartman as they rafted down the suddenly raging river. That?s one thing I knew about rivers: you absolutely must respect their floodplains.

But people would talk about the rich soils in said floodplains, and I?d look at the rocks and thin dirt left by receding floodwaters in ours, and scratch my head in puzzlement. Harf?

I remember being delighted the day Jim Bennett taught me the word ?riparian,? and showed me we actually had some of said riparian habitat in Arizona. It was nice to have a word for the areas that were green and lush compared to the searing dry country round them.

So that was a river: often bone-dry, rocky, likely stuck at the bottom of a deep canyon, occasionally dangerous but never floody for long, most recognizable due to a straggling line of trees, although those weren?t always present. These Arizona streams warped my perception of what a river is. I spoke a few river words, not fluently. I knew broad, deep, always-flowing rivers existed, but didn?t have any direct experience with them.

Then I moved to the Pacific Northwest. On the western side of the Cascades here, even the tiniest rivulets are likely to be carrying water the majority of the year. Dry dirt is a novelty. Most of the creeks could eat Arizona?s creeks for breakfast and still have room for elevenses, lunch, tea, dinner and supper, and the rivers laugh in in our rivers? general direction. They even snigger at the mighty Colorado: ?Oh, look, isn?t that precious ? it?s pretending to be a real river!? Even on Washington?s dry side, I ran in to more river than I was prepared for. This shit has water in it, people, and you can walk up to it without having to climb down a 1000 foot drop.

And the rivers on the west side ? they were aliens. I had no idea what they were on about. Some of them flowed straight and quiet through cities, and I didn?t understand them at all until I discovered they?d once meandered here and there over valley floors until humans straightened them out.

Then there were rivers that still had their rough edges, and displayed behaviors I?d heard rivers that always had water in them were supposed to indulge in, like creating gravel and sand and point bars, meandering, and doing interesting stuff to their banks. They were also eye-poppingly wide.

The Skykomish River at Al Borlin Park, Monroe, WA. This is the first river here that I grew familiar with that wasn't thoroughly domesticated. Humans have mucked it about in places, but it's still fairly wild, and it's like so many of our Pacific Northwest rivers: it starts small and builds to something enormous enough go motorboating on. I'm still a little surprised when I see plain ol' motorboats zipping up these rivers, but I'm getting gradually used to it.

And when you went up into the mountains, where they arose, they changed character quickly. They were full of rapids, weren?t flowing through such wide, flat floodplains, and were fast, narrow, wild waters hurtling down-mountain with joyful abandon.

The Skykomish near Gold Bar. Okay, it's still bloody enormous by Arizona standards, but considerably narrower and swifter here than it is at Al Borlin Park a few dozen miles downstream. There are words for the tall, steep bank it's cut, and the bouldery flat bit my intrepid companion and I were wandering all over that day. There are words for what it does, what it is, and what changes it goes through. There's a whole language of rivers, and I only speak enough to get myself into trouble with the natives.

These rivers were often glacier-fed, cold as fuck, wild colors, and did things most Arizona rivers never seemed to do. I began learning words like fluvial. There are fluvial processes, and things like fluvial terraces, and all sorts of mad things rivers leave behind. They create deltas, sometimes enormous deltas. There are estuaries where rivers meet the sea. Gargantuan floodplains built up thick piles of sediment. And those things leave traces in the geologic record. Arizona?s rivers, in fact, once were mighty, and left vast swaths of rock that show they affected enormous areas.

Standing on an ancient floodplain, the Hermit Formation. I forget what Sugarloaf, that big knob o? rock in the center, is ? possibly part of the Schnebly Hill Formation. Still. Hermit. Under our feet. Rivers ran through here, and flooded, and left thick sediments that turned into some of Sedona?s brilliant red rock. And it?s hard for me to comprehend how these ribbons of water can do this. I don?t speak their language. They can?t explain to me what they?re doing, how and why. We sit together, and the rivers speak, but all I hear is sounds. It?s like being babbled at by a native Russian speaker: a stream of sound flows by, and occasionally a word bobs in the current that I can pick out, recognize, and I nod enthusiastically: ?Da! Da!? I get that word, although I have no idea how it relates to the others. Then we?re right back to nyet.

Fortunately, I have friends who speak the language of rivers. They?re slowly teaching me to speak it. And while I?ll never be as fluent as they are, I?ll at least be able to say, ?My aunt?s fluvial terrace is on my uncle?s watershed? with confidence, though with a horrific accent. And while I return to more explosive matters over at Rosetta Stones, we?ll be largely exploring hydrogeology here, in between the usual fare.

Rivers, my friends, are geologically fascinating entities. They come in a variety of styles. And if you don?t speak their language, they may kill you. Also, here in the Pacific Northwest, they?ve interacted with volcanoes in intriguing ways. Additionally, they are beautiful. Reasons enough to learn their lingo, eh?

Pakistan is Saudi Arabia's traditional ally in South Asia, as firstly both nations are Islamic countries with majority Sunni populations, and the latter having fueled the construction of many hard-line religious schools in Pakistan that have helped foster Islamist militancy.

But the Middle East nation is trying to maintain close ties with India, Pakistan's nemesis in the region, the Wall Street Journal reports.

According to the paper, there are many theories for why Saudi is cooperating more closely with India.

Some observers view Saudi policy as driven by worries about the inability of Pakistan to control its militant proxies. Those anxieties have heightened in recent years as militants have increasingly attacked Pakistani government and military targets, the paper said.

"There's a genuine concern in the Saudi establishment that things may get out of hand," said Naresh Chandra, chairman of India's National Security Advisory Board.

According to Talat Masood, a retired Pakistan army general, Saudi Arabia, once itself a source of funds for Pakistan-based militant groups, now views its closer relationship with India as a way of forcing Pakistan to moderate its support for these groups, the paper said.

"The Saudi relationship is no longer a monopoly of Pakistan," Masood said.

Some analysts also claim that Riyadh's ties with India offer another way to balance the influence of Iran, a Shiite power that has historically rivaled Saudi for influence in the Middle East and South Asia, the paper added. (ANI)

TERMS AND CONDITIONS OF SALE

Definitions

?Asset? or ?Assets? means the asset or assets that the Buyer has agreed to purchase from the Seller, subject to these Terms and Conditions;

?Buyer? means the person or entity purchasing the Assets;

?GoIndustry DoveBid? means GoIndustry (UK) Limited (No. 04092016) whose registered office is at St. Andrew?s House, 18-20 St. Andrew Street, London EC4A 3AG;

?Notice to Purchasers? means the notice issued to the Buyer in connection with the sale of the Assets, the terms of which shall be supplementary to these Terms and Conditions;

?Protected Marks? means any trade marks, trade or business names, logos, design rights (whether registrable or otherwise), applications for any of the foregoing or any other intellectual property rights of the Seller or any Seller Affiliate, including marks and designs relating to the Olympic or Paralympic Games, any Olympic or Paralympic teams, the Olympic Symbol (i.e. the five interlocking rings of the IOC), the Paralympic Symbol (i.e. the three agitos of the International Paralympic Committee), the words ?Olympic?, ?Olympian?, ?Olympiad?, ?Paralympic?, ?Paralympian?, ?Paralympiad? (and their plurals) and/or any other word(s), motto, symbol or representation protected by the Olympic Symbol etc. (Protection) Act 1995, the London Olympic Games and Paralympic Games Act 2006 (whether as now in force or as amended in the future) or by any other legislation enacted in relation to the Olympic and/or Paralympic Games;

?Seller? means The London Organising Committee Of The Olympic Games And Paralympic Games Limited (No. 5267819) whose registered office is at One Churchill Place, London E14 5LN and its successors and assigns;

?Seller Affiliates? shall mean the IOC, the IPC, the British Olympic Association, the British Paralympic Association, the Olympic Delivery Authority or any other organising committee of an Olympic and/or Paralympic Games; and

?Terms and Conditions? shall mean these Terms and Conditions of Sale for the Assets.

As is

1. ALL ASSETS ARE SOLD AS IS, WHERE IS AND WITH ALL FAULTS. ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING THOSE AS TO THE NATURE, QUALITY, QUANTITY, VALUE OR CONDITION OF ANY ASSET, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE HEREBY EXCLUDED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW. The Buyer acknowledges that any software or intellectual property rights attaching to any Assets may not be the property of the Seller or capable of transfer by the Seller. Neither the Seller nor GoIndustry DoveBid is in any way authorising the use by the Buyer of such software or intellectual property rights and any use of such software or exploitation of such intellectual property rights shall be at the Buyer's sole risk.

2. Illustrations, pictures or videos posted on GoIndustry DoveBid?s website (the ?Site?) or otherwise provided by the Seller or GoIndustry DoveBid are for the convenience of the Buyer only. GoIndustry DoveBid has used its reasonable endeavours to ensure that the descriptions of each Asset appearing on the Site are accurate, but the Buyer relies upon such description at its own risk. Buyers should satisfy themselves prior to the sale as to the condition of the Assets and should exercise and rely on their judgment as to whether the Assets accord with their description at their own risk. Subject to the obligations accepted by GoIndustry DoveBid under these Terms and Conditions, neither the Seller nor GoIndustry DoveBid nor any of their respective employees or agents are responsible for errors of description or for the genuineness or authenticity of any Asset.

3. The Buyer acknowledges that all Assets are second hand and have been used continuously by the Seller in connection with the Olympic and/or Paralympic Games 2012 and will be subject to commensurate wear and tear as a result. Where the Assets are sold in a batch there may be greater degrees of wear and tear of the Assets within that batch and the total price paid for the Assets reflects this fact.

General

4. By submitting an offer, the Buyer represents, warrants and undertakes that it has the authority and capacity to make such an offer and purchase the Assets and that any offer that it makes constitutes an irrevocable offer to buy the Assets for the full offer amount upon these terms and conditions (and such additional terms and conditions (if any) as may be imposed by the Seller). For the purposes of these terms and conditions, we refer to any person or entity registering to offer or offering to buy goods as a "buyer" regardless of whether any contract of sale is concluded.

5. The Seller or GoIndustryDoveBid may at its discretion alter or withdraw all or any Assets for sale prior to the conclusion of an agreement for sale with the Buyer.

Payment terms

6. The Buyer shall pay to GoIndustry DoveBid such premium ("Buyer's Premium") as set forth in the Notice to Purchasers or otherwise set forth on the Site for the privately negotiated sale in question to which will be added any applicable value added tax or the equivalent or similar sales taxes in the relevant jurisdiction at the current rate. The Buyer's Premium is not negotiable and is payable by all Buyers. GoIndustry DoveBid, when acting as agent for the Seller, may also receive commission from the Seller.

7. Payment for the Assets is required as stipulated in the Notice to Purchasers or the invoice or as otherwise set forth on the Site for the privately negotiated sale in question. Buyers shall be responsible for any charges raised in respect of conversion or transfer of monies. If goods are exported, tax refunds or zero rating may apply, tax refunds (if any) will be made by GoIndustry DoveBid, subject to receipt of (i) satisfactory proof of export by the Buyer; (ii) the corresponding amount of tax refund from the relevant tax authority or the Seller and (iii) the relevant tax forms (if applicable).

8. The Buyer is advised to seek its own tax advice. The Buyer agrees that invoices may be issued in electronic form by email or otherwise.

9. If payment for any of the Assets is made by credit card, such payment may only be made by a Visa credit card unless otherwise stipulated in the Notice to Purchasers.

10. If the Buyer fails to pay for the Assets as stipulated in the Notice to Purchasers (including any delivery charges in respect of the Assets (if relevant)), the Seller shall have the right to charge interest on the overdue amount at the rate of 1 per cent. of the total overdue amount per calendar month, accruing on a daily basis from the date of the unpaid invoice until the date that payment of the overdue amount is received in full.

11. If the Buyer has still not paid any overdue amount within 30 days of the date of the unpaid invoice, the Seller and GoIndustry DoveBid shall be entitled to resell or otherwise dispose of part or all of Assets which are the subject of the unpaid invoice.

Collection/Removal

12. The Buyer will:

(a) collect the Assets that it has purchased from the Seller's premises as specified in the Notice to Purchasers no later than the date for collection set forth in the Notice Purchasers or otherwise set forth on the Site for the privately negotiated sale in question (the ?Collection Date?);

(b) only remove the Assets that it has purchased by previous arrangement with, and subject to the supervision of GoIndustry DoveBid or its agent(s) or appointed representative(s);

(c) ensure that it has an appropriate vehicle to collect the Assets that it has purchased. The Seller reserves the right to refuse collection by the Buyer if it deems, acting reasonably, that the Buyer?s vehicle is not suitable to safely transport the Assets that it has purchased;

(d) comply with any other reasonable instructions relating to the collection of the Assets that it has purchased, which are issued by the Seller and/or GoIndustry DoveBid;

(e) not be permitted to remove any Assets that it has purchased from the Seller's premises until all sums due in respect thereof have been paid;

(f) if it fails to collect the Assets that it has purchased by the date specified in the Notice to Purchasers, be liable to pay a storage fee of ?10 per week (or part of) for every pallet (or part of) that the Assets that it has purchased are required to be stored on (the ?Storage Fee?);

(g) if a Storage Fee has been incurred by the Buyer in respect of all or part of the Assets that it has purchased, not be permitted to remove any Assets that it has purchased from the Seller's premises until the Storage Fee has been paid in full. If any Assets that it has purchased have been the subject of an unpaid Storage Fee for a period of more than four weeks, the Seller and GoIndustry DoveBid shall be entitled to resell or otherwise dispose of part or all of any such Assets;

(f) be responsible for the removal and insurance of the Assets that it has purchased at its own expense; and

(e) where so requested by the Seller and/or GoIndustry DoveBid, provide method statements and/or risk assessments for the removal of the Assets to the satisfaction of the Seller and/or its appointed representative(s).

13. If, in GoIndustry DoveBid's opinion, removal of any Assets or part thereof will be likely to cause serious damage to the Seller's premises, or any other damage which the Buyer is either unable or unwilling to rectify or is being undertaken without an approved ?method statement? and/or ?risk assessment?, GoIndustry DoveBid may by notice to the Buyer rescind the sale of such Assets or permit the removal thereof from the premises to proceed subject to such conditions as it may think fit to impose. GoIndustry DoveBid shall have no responsibility to disconnect utilities to the sold Assets, including electric, gas, waste and water lines.

14. The Buyer shall provide, or ensure that their agent(s) performing removals on its behalf provide, on demand, evidence of insurance policies reasonably satisfactory to GoIndustry DoveBid and/or the Seller.

15. Without prejudice to any claims that GoIndustry DoveBid and/or the Seller may have against the Buyer for breach of contract or otherwise the Buyer will become liable from the Collection Date for all storage, security and administration expenses and the cost of and incidental to re-selling and/or otherwise disposing of un-cleared items.

16. If any Assets are offered for delivery by the Seller or its agents and the Buyer elects to take up such option at the time that it purchases any such Assets, the Buyer shall be responsible for paying all costs which are specified in respect of the delivery of such Assets and shall comply with all terms relating to delivery which are set out in the Notice to Purchasers.

17. The Buyer acknowledges that the Seller's facility is a potentially dangerous place. Flammable, noxious, corrosive and pressurized substances may be present. Heavy equipment may be operated, and electrical circuits may be live. Every person enters the site at his or her own risk with notice of the condition of the premises and the activities that will be or have been conducted on the premises. Buyers shall so advise their agents and employees. No person shall have any claim against GoIndustry DoveBid, the Seller or their respective agents or employees for any injuries sustained or for damages to or loss of property that may occur at the site. Nothing in this clause shall limit or exclude liability for death or personal injury resulting from the negligence of GoIndustry DoveBid or the Seller.

18. The Buyer acknowledges that neither the Seller nor its appointed representative(s) are obliged to give any other support or owes any other performance other than those described in these Terms and Conditions. In particular, the Buyer acknowledges that neither the Seller nor GoIndustry DoveBid will give any start-up assistance or trouble shooting support during re-assembling and start-up of the Assets unless otherwise agreed in writing.

International statutory compliance exclusion.

19. It is expressly brought to the Buyer's attention that, at the time of sale, any Assets:

(a) may not necessarily comply with the Health and Safety at Work Etc. Act 1974, Environmental Protection Act 1990 or any other UK and/or EC Acts, Regulations, Directives or their applicable laws or equivalent or similar laws in any relevant jurisdiction or; and

(b) could contain blue or white asbestos, hazardous substances, dangerous chemicals etc. which if not handled correctly during their removal from a site could be in breach of the Health & Safety at Work Etc. Act 1974, Control of Substances Hazardous to Health Regulations 2002 or any other current legislations covering the use of such substances in a working environment in the UK, the EC, the United States or any other relevant jurisdiction. GoIndustry DoveBid has no duty to remove any hazardous substances that are contained in or are a part of any Assets.

20. The Buyer undertakes to:

(a) remove, ship and use any purchased plant and equipment within any relevant jurisdiction in a way that does not contravene any relevant legislation and in full compliance with all applicable health and safety standards and regulations; and

(b) comply with all current applicable legislations in any relevant jurisdiction and reasonable instructions by GoIndustry DoveBid in relation to the removal/disposal of waste including hazardous waste.

Exports

21. The Buyer agrees to comply with all applicable export control and related laws and regulation and not to violate any applicable local, state, national or international law, statute, ordinance, rule or regulation. Buyers acknowledge that GoIndustry DoveBid is not the exporter of any purchased Assets unless expressly stated. GoIndustry DoveBid makes no representation or warranty concerning, and has conducted no investigation to ascertain which Assets, if any, constitute, for example, ?Restricted Technology? for US law purposes or whose export is otherwise restricted under applicable law. GoIndustry DoveBid and/or the Seller reserves the right to cancel or rescind any sale at any time in the event it determines, in its absolute discretion, that the sale does or may violate applicable export or import control or related laws and regulations.

Transfer of risk and title

22. Subject to clause 23, upon notification of acceptance of its Offer, the Buyer shall assume all risks in and relating to the Assets. The Buyer is advised to effect in respect of all such risks arising thereafter any insurance it may consider necessary. The duty of GoIndustry DoveBid and/or the Seller to make Assets available shall be deemed performed upon notification of acceptance of the Buyer?s offer even if an Asset is subsequently damaged.

23. If after notification of acceptance of its Offer GoIndustry DoveBide and/or the Seller lose or damage (beyond reasonable repair) the Asset that is the subject of that Offer, the Buyer shall be entitled to a refund of the purchase price for that Asset in the amount actually paid to GoIndustry DoveBid for that Asset. Such refund shall not include any ancillary expenses incurred by the Buyer in connection with the Asset.

24. Property and title in each Asset shall not pass to the Buyer until:

(a) full payment therefore has been received or (where payment or part payment is made by cheque) until the cheque(s) in question have been cleared; and

(b) each such Asset has been removed from the Seller's premises in its entirety.

Limitation of Liability

25. Neither the Seller nor GoIndustry DoveBid shall be liable, in contract, tort (including negligence) or for breach of statutory duty or in any other way for:

(a) any loss arising from or in connection with loss of revenue, profits, contracts or business or failure to realise anticipated savings or profits;

(b) any loss of goodwill or reputation; or

(c) any indirect or consequential losses suffered or incurred by Buyer,

arising out of or in connection with these Terms and Conditions and any of the actions or events contemplated within them or deriving from a sale of goods pursuant to them (?Relevant Events?).

26. The aggregate respective liability of the Seller or GoIndustry DoveBid in respect of any other loss or damage suffered by a Buyer and arising out of or in connection with these Terms and Conditions or arising out of or in any way connected with any Relevant Events, whether in contract, tort (including negligence) or for breach of statutory duty or in any other way, shall not exceed (i) in the case of the Seller, the amount of the purchase price paid by the Buyer; and (ii) in the case of GoIndustry DoveBid the buyer?s premium paid by the Buyer, in each case in respect of the goods which are the subject of the claim.

27. The Buyer undertakes to defend (by counsel satisfactory to the Seller) and indemnify GoIndustry DoveBid, the Seller and the Seller Affiliates (the ?Indemnified Parties?) and hold the Indemnified Parties harmless from and against any claim, demand, cause of action, liability or expense (including attorneys' fees and costs) asserted against or incurred by the Indemnified Parties or any third party in connection with the sale, removal, shipment or use of any Assets that it has purchased or a breach by the Buyer of these Terms and Conditions.

28. Nothing in this clause shall limit or exclude liability for death or personal injury resulting from the negligence of the Seller or GoIndustry DoveBid or their respective employees or agents.

29. Notwithstanding any contrary provision in these Terms and Conditions, neither the Seller nor GoIndustry DoveBid limits or excludes its liability in respect of fraud, any breach of section 12 of the Sale of Goods Act 1979 or any other statutory or other liability which cannot be excluded under applicable law.

30. GoIndustry DoveBid is acting as agent of the Seller and is not responsible for acts and omissions of the Seller or any of the Seller?s principals, officers, directors, employees or other agents.

No Marketing Rights

31. The Buyer shall not:

(a) by purchasing any Asset, acquire any right, title or interest in the Protected Marks or any right to associate itself with the Seller or any Seller Affiliate or the Olympic or Paralympic Games (the ?Games?) (whether prior to, during or after the Games take place);

(b) other than where such appears directly on any Asset that it has purchased, use any Protected Marks or any trade marks, trade names or logos so resembling the Protected Marks as to be likely to cause confusion with the Protected Marks;

(c) undertake any form of ambush marketing;

(d) cause to be done, or permit anyone reasonably within the Buyer?s control to do, anything which might damage or endanger the validity or distinctiveness of, or the goodwill in, the Protected Marks; or

(e) do anything which would have an adverse effect on or embarrass the Seller, any Seller Affiliate, or any official supporter or sponsor of the Games.

32. The Buyer shall not, and (where relevant) shall draw to the attention of its employees that they shall not, without the prior written approval of the Seller use in advertising, publicity or any other communication, whether written, electronic or any other means, any Protected Mark, the name of the Seller or any Seller Affiliate, or of any of their directors or employees

33. Clauses 29 and 30 shall continue to apply without limit of time.

Third Party Rights

34. Any Supplier Affiliate may enforce the terms of Clauses 27, 31 and 32 in accordance with the Contracts (Rights of Third Parties) Act 1999 (the ?Act?).

35. The Parties to these Terms and Conditions do not require the consent of any third party to rescind or terminate these Terms and Conditions in accordance with its terms.

36. Except as expressly provided in Clause 34, no term hereunder is intended to confer a benefit on, or to be enforceable by, any person who is not a Party to these Terms and Conditions whether under the Act or otherwise.

Choice of Law and Venue

37. These Terms and Conditions and any claims (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and the Parties hereby irrevocably submit to the exclusive jurisdiction of the English courts over any claims, disputes or matter arising from these Terms and Conditions.

38. None of these Term and Conditions shall be relied upon or be enforceable under the Contract (Rights of Third Parties) Act 1999 by any third party who is not party to these Terms and Conditions.

39. In the event that any of the provisions of these Terms and Conditions shall prove to be invalid or null and void, the remainder of the provisions shall not affected thereby.

These Terms and Conditions are drawn up in the English language. If these Terms and Conditions are translated into another language, the English language text prevails.

(click image for larger view and for slideshow) The anticipation for Windows 8 is more than just hype. This is no minor update of Microsoft's flagship operating system, which runs on the lion's share of personal computers worldwide.

Yet some of the same factors generating excitement about Windows 8--mobility and a sleek new look-and-feel are exhibits A and B--could also create high hurdles for some SMBs on the path to adoption. Those hurdles can be cleared provided you know they're coming. Here are four to consider as you work to avoid getting tripped up.

1. Still on XP. Windows XP is still widely loved--as evidenced by the fact that it's still widely used, even with Microsoft set to pull the plug on support in April 2014. Depending on whose numbers and methodology you use, XP still powers between 20% and 40% of all PCs. That holds true when focusing only on SMB users: 24% of U.S.-based SMBs are still running XP, according to recent Techaisle data. That jumps to 43% of SMBs globally.

SMBs still on XP face a more complex upgrade choice, because they'd be skipping two versions to get to the newest one. Some XP shops are already underway with a migration to Windows 7 or just recently completed one. Then there's the fact that XP users are likely using older hardware. Though it might meet the minimum technical requirements for Windows 8, that gear probably isn't going deliver a productive experience. Windows 8 simply wasn't developed for XP-era hardware.

Can you upgrade directly from Windows XP to Windows 8? Yes. Should you? Maybe, maybe not. Migrating to Windows 7 is generally viewed as the safer move for XP desktop and laptop users. (That wasn't always the case.)

2. Hardware costs. Even relatively new hardware won't necessarily be optimal. Microsoft acknowledges as much in its Windows 8 Release Preview info. Windows 8 was designed for touch; legacy Windows equipment was not. Software upgrade prices may be palatable for SMBs, but new hardware likely means a significant capital expenditure. The best Windows 8 experience will require new devices--touch-screen PCs, tablets, or some combination of the two. A reasonably optimal deployment might stick with non-touch PCs but still require investing in new tablets--that hardware simply didn't exist until now in Windows environments, so there's no such strategy as extending the hardware refresh cycle.

3. User disruption. Whether you're responsible for one person or 100--or 1,000 people, for that matter--there's no way around the fact that Windows 8 looks and feels much different than previous versions. The UI overhaul can be managed but not ignored. Some InformationWeek readers have pointed out the new UI isn't rocket science--it just takes a little getting used to. They're probably right; they're also probably more technical than the typical user. (If you've been using Windows 8 since day one, that's you.) For everyone else, there's going to be a learning curve--something the IT pros who help them can't scoff at. Reader "Mark532010" notes that while a teenager might not miss a beat with Windows 8, "for the existing non-expert people who use Windows to get their work done it will be a nightmare. ... It will be quite difficult for me as a support person."

4. BYOD office. Windows 8 could become a single platform to bridge the gap between home and office. That would appeal to IT departments that don't want to deal with employee-owned iPads and other devices on the corporate network.

Therein lies a Catch-22: Love or hate BYOD, deploying Windows 8 is no easy fix. If you're in the "love" category, that means you probably have a cornucopia of devices and OSes on your network already; Windows 8 is just another one. If you're on the "hate" side of the BYOD spectrum, refer back to point number two. It's tough to enforce a no-BYOD policy without offering employees a company-issued alternative. It could get very expensive for SMBs to outfit their personnel for Windows 8, particularly if an employee needs multiple devices--PC, tablet, and phone. Theoretical BYOD salvation comes with a real cost.

Writers and content producers are always looking for a fresh perspective, and sometimes subjects completely unrelated to a niche can send you down a rabbit hole of creative thought.

Robert Bruce recently sent me a stark email with the subject line ?Read Me? and a link to a short article about baseball great Ichiro Suzuki and the strange ritual that dictates how he prepares for each game.

At first it seemed weird and unrelated to what we teach at Copyblogger ? then the connection came to me in a flash.

Before each game, Ichiro breaks in his 8 hand-crafted bats made of a very special wood imported from Hokkaido, Japan. The bats are always the same exact weight and length (33.46 inches, 31.75 ounces).

But the strangest part about Ichiro?s pre-game ritual is that he keeps them in a dehumidifier, a special case that he takes with him to every game that ensures the bats have a perfect ?feel?.

He cares for his tools as if they were priceless antiques, and many of his teammates don?t.

But they?re starting to wonder if it doesn?t give him some kind of professional advantage.

How rituals bring meaning to your writing

The rituals of successful athletes aren?t unlike those of very productive writers.

Both use pre-game rituals and training techniques, some stranger than others, to help them get into a mental state that makes them perform at their peak.

Novelist Truman Capote also wrote everything in longhand in the horizontal position. Don?t forget, proper rest is crucial to creativity, so if you?re already there, why not grab the laptop and give it a try?
  2. Take a walk or bike ride without a destination in mind.
    Charles Dickens and Henry Miller both used to wander around Europe trying to get lost, a technique that psychologists say can foster creativity.
  3. Put on some tunes (preferably without words).
    Copywriter and prolific email marketer Ben Settle swears by the soothing sounds of music, not just any music but ?inspirational movie soundtracks? on repeat.
  4. Write at a time of day that suits your productivity.
    Honor? de Balzac would get up at midnight and drink black coffee well into the next day. Flannery O?Connor only wrote for two hours a day.
  5. Loosen up.
    Pulitzer Prize winning author John Cheever wrote mostly in his underwear. My friend and prolific travel journalist Adam Skolnick used to write only in a sarong.
  6. Save your back.
    Ernest Hemingway and Albert Camus both found the exhilaration and pain-saving exercise of writing while standing, a technique that is finding resurgence among health-conscious writers, including our own Brian Clark.
  7. Invoke the help of some divine inspiration.
    Prolific inspirational writer and author of The War of Art, Steven Pressfield uses an ancient ritual of reciting Homer?s invocation of the Muse before he types a word. He?s in good company, as they were invoked by Shakespeare, Milton, and Chaucer too.
  8. If all else fails, have a drink ? or two.
    Immortal copywriter David Ogilvy would drink a ??half bottle of rum and play a Handel oratorio on the gramophone.? He also claimed to be a lousy copywriter but a great editor. He would edit his writing 4 or 5 times before showing it to anyone.

What?s your ritual?

Remember, no ritual should ever take the place of actually getting words on the page . But they can help you shift your mindset just enough to see things in a fresh way.

In the immortal words of novelist and screenwriter Raymond Chandler:

Technique alone is never enough. You have to have passion. Technique alone is just an embroidered potholder.

Pools provide a great opportunity to relax as well as exercise, so it?s important to pick one that suits your lifestyle as well as your design preferences ? whether indoors or outside in your garden.

Do you want to swim laps to challenge our Olympians, or are you looking for somewhere to take a leisurely dip with friends and family? Will you have children in the pool or is it for adults only? Do you want to be able to swim all year round, or are you looking for a fair-weather option? Questions such as these will affect your choice before buying. Also, bear in mind that a well-constructed and designed pool can add value to the price of your property but if the building work is shoddy, it will do the opposite.

How much will it cost to create and maintain?

When it comes to building a pool, you should consider not just the price of the pool itself, but how much it will cost to maintain. Of course, the price of the pool will vary according to its size, style, design and any additional installations. Fitted lights, heaters, diving boards and jet bubbles all make a swimming pool more luxurious, but they come at a cost. For indoor pools, you may want to consider roll-on, roll-off floors that can transform a pool room into a comfortable games room, providing usable space in minutes and at the touch of a button. Contractors such as Portrait Pools also offer automatic swimming pool covers that mould to any shape or design.

Remember to take into account the cost of pool insurance and maintenance. Often, the contractor that builds the pool will be able to offer a service that includes weekly, monthly or holiday maintenance. This will be determined by the pool?s location ? indoors or out ? plus its size and how often it is used. The pool?s temperature, clarity and pH levels all need to be checked and maintained, and are crucial to whether you can use your pool as and when you want.

How long will it take to build a pool?

This will vary depending on style and the number of features you want to include. On average, to build an in-ground swimming pool will take approximately six to eight weeks. A basement pool will require extensive excavations, and a typical basement will take approximately 10 to 16 weeks for the structural phase to be completed. The actual swimming pool build will be additional to this.

What about the paperwork?

If you want to build a pool, you must get planning permission and comply with building regulations. Contact your local council, which will have more information. If the pool has a capacity greater than 10,000 litres, which is designed to be refilled automatically with mains water, you must also inform your water and sewerage company or authority before you begin work. There are also guidelines on energy conservation and low energy use that relate to swimming pools. Finally, if you want to empty your pool, you should check the best way to dispose of the water with your environmental regulator or water and sewerage company or authority. You?ll need authorisation to dispose of pool water into sewers, surface waters or groundwater.

Disco Sun: X-Class Flare Creates Strobe-Light Effect

An active region just turning into view on the left side of the Sun has emitted three large flares since Saturday: an M9, an M5 and early today blasted out an X1.8 class flare. This flare occurred around 3:17 am UTC today (or 11:17 pm EDT on Oct. 22). The strobe-light-like effect visible in the video was created by the brightness of the flare and how the instruments on the Solar Dynamics Observatory responded to it. Phil Chamberlin, Deputy Project Scientist SDO told Universe Today that built in algorithms called ?active exposure control? compensate for the extra light coming in from a flare. It doesn?t always result in the strobe or fluttering effect, but the algorithms create shorter exposure time, and thus a dimmer, but still scientifically useful view of the entire Sun. The algorithms go into effect whenever there is an M class or higher flare.

Solar flares are powerful bursts of radiation. Harmful radiation from a flare can?t pass through Earth?s atmosphere and pose a hazard to humans on the ground, but flares like this can disturb the atmosphere in the layer where GPS and communications signals travel, and an X-class flare of this intensity can cause problems or even blackouts in radio communications.

A Coronal Mass Ejection (CME) was not associated with this flare, and the flare was not directed at Earth, so scientists do not expect any additional auroral activity to be a result of this latest blast from the Sun.

The SDO Twitter feed said there is a 75% chance of more M-class solar flares from this active region and a 20% chance of additional X-class flares.

This is the 7th X-class flare in 2012 with the largest being an X5.4 flare on March 7.

By observing the sun in a number of different wavelengths, NASA?s telescopes can tease out different aspects of events on the sun. MORGANTOWN, W.Va. (AP) ? The final touchdown pass drew only a slight fist pump from Collin Klein. It was still the third quarter, but Milan-Puskar Stadium was half-empty. Most of the West Virginia fans had seen enough of a game that had turned into a Heisman Trophy campaign ad for the Kansas State quarterback.

Klein threw for a career-high 323 yards and three touchdowns and ran for four scores as No. 4 Kansas State got little resistance from No. 17 West Virginia in a 55-14 victory Saturday night.

The Wildcats (7-0, 4-0 Big 12) made it look easy. Klein completed 19 of 21 passes and added 41 yards rushing.

"I think we all felt comfortable tonight," he said. "The coaches did a great job of building a game plan and putting us in positions to succeed."

No doubt. The Wildcats scored on their first eight possessions, including seven straight touchdowns.

"He doesn't do anything wrong," West Virginia coach Dana Holgorsen said of Klein. "He's hard to tackle. He gets them in good plays. He doesn't turn the ball over. You can say what you want to about the throwing motion, but it goes exactly where he wants it go. He's a good football player."

Way too good for West Virginia to stop.

It was no surprise the Mountaineers (5-2, 2-2) were awful on defense ? it's been that way all season. For the second straight game, though, Geno Smith and the offense did nothing to keep it close.

Smith followed up a clunker at Texas Tech last week with an even worse game, throwing his first two interceptions of the season and finishing 21 of 32 for 143 yards. The senior has gone from Heisman Trophy front-runner to long shot in two weeks.

"We talked about it all week. Don't get impatient. Don't get impatient," Holgorsen said. "You have the ball a couple of times and you look up there and you're down 17 points and you start pressing. It's inevitable.

"We're trying to score 14 points in one play."

Kansas State made it 52-7 with 2:25 left in the third quarter when Klein hit Tyler Lockett over the middle for a 20-yard score. Klein turned toward his sideline and gave a modest shake of his fist before joining his teammates to celebrate. It was the fourth time this season the Wildcats had scored in the 50s.

By that point a long line of cars was creeping out of the parking lot. The only section of the stadium that was still filled was covered in KSU purple.

"I was certainly pleased with the way that our youngsters approached the ballgame, the preparation for the game and how they traveled," said Bill Snyder, whose remarkable 21-year, two-act career as Kansas State coach is only missing a national championship. "I was proud of how they kept their focus. We played great."

The optimism and excitement that was pumping through Morgantown a couple of weeks ago is gone.

In Manhattan, Kan., it's all good, and everything is on the table for Snyder's team. The Wildcats are the only unbeaten squad in the Big 12. Their quarterback is the Heisman front-runner. And with five games left on the schedule, the Wildcats are serious national title contenders.

The first meeting since 1931 of the new Big 12 rivals was so lopsided that by the time it was over it was hard to even remember that it started as a battle for first place in the conference.

On one side was Klein, aka Optimus Klein, the Wildcats' methodical battering ram, whose passes don't look like much, but usually find their target.

On the other side was Smith, the future NFL first-round draft pick with the video game passing statistics.

But Klein got to face West Virginia's beleaguered defense, which ranks near the bottom of the Big 12 and the country in just about every statistic.

With the Mountaineers seemingly determined to at least stop the run early, Klein completed his first seven passes, including a 10-yard touchdown that Lockett made a stretching, toe-dragging catch on in the back corner of the end zone. That made it 10-0 in the first.

The K-State running game went to work on the third drive and Klein finished it off with a 1-yard plunge.

Klein made it 24-0 on the next Kansas State drive, taking an option keeper 8 yards. That gave him 39 rushing touchdowns over the last two seasons to break an FBS record held by Eric Crouch of Nebraska and Stacey Robinson of Northern Illinois.

Tavon Austin finally put a little life back into the sellout crowd when he took the ensuing kickoff back 100 yards for a score with 4:12 left in the first half.

The bad news for West Virginia was that it gave the Wildcats more than enough time to get the ball back in the end zone ? which they did with another 1-yard dive by Klein.

The first-half onslaught went like this for Kansas State: five possessions, 346 yards, four touchdowns and a field goal. The offense was unstoppable and the defense was just as good, holding Smith to 62 yards by flooding the secondary with defenders and getting a pass rush without blitzing much.

"I thought our defense played well and played aggressive and pursued the ball," Snyder said. "We had a relentless pass rush and we got our hands on Geno Smith."

Maybe the pressure of having to score every time he touches the ball has gotten to Smith, too. That trip to New York for the Heisman Trophy presentation, which seemed like a lock after the Mountaineers won at Texas, is now in serious doubt.

"This is about as low as it gets," Smith said.

As for Klein and the Wildcats, they will face tougher tests. The gap between the top and the bottom of the Big 12 doesn't seem all that wide. But they have now won three conference road games, including at Oklahoma. They came into the weekend fourth in the BCS standings, behind Alabama, Florida and Oregon.

With their 73-year-old coach pushing all the right buttons and their happily married quarterback making all the right plays, the Wildcats might be due for a promotion.
